Cape Town - Sibusiso Leope avoided legal action on Thursday when he acknowledged Forbes Africa’s concerns that an image he tweeted this week was misleading and represented an affiliation that did not exist.
The radio personality and entrepreneur known as DJ Sbu came to an "amicable agreement" with Forbes Africa magazine, after he retweeted a picture of a fake cover of the magazine that featured him clutching a can of his energy drink, Mofaya.
Forbes Africa this afternoon confirmed that the situation had been resolved and that Leope had agreed to remove the picture – which went viral – from his social networking accounts.
The magazine acknowledged Leope’s “spirit of entrepreneurship” but said that “the unlicensed use of Forbes Africa’s exclusive intellectual property rights” was in contention.

Leope has been under fire for his attempts to punt his product in what has been described as walking a fine line between marketing genius and breaking the rules.
He has been suspended from his DJ gig at Metro FM for punting Mofaya at the radio station’s awards event.
And the South African Broadcasting Corporation has indicated that it is considering recouping advertising revenue from him pending a probe into the number of times he has mentioned the energy drink on-air.
Meanwhile, Leope has remained upbeat, tweeting that he “took all the bullets for all the black kids from the ghetto.
"I took it for all entrepreneurs. I stood for truth just to make you proud but you gave me nothing but hate."
He gave a shout-out to those who stood by him, tweeting that "the grass was cut. All the snakes exposed themselves" and then went on to link to an Instagram photo of him on the cover of the March edition of YoMzansi magazine, clutching a bottle of Moflava, and quipped: "Proper cover. And No! It’s not fake."
